By accessing, browsing, signing up for an account, or using Borderly.io (the "Service"), you ("User", "you") acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Service. Continued use constitutes ongoing acceptance of these Terms, including any future modifications. We may update these Terms at any time, at our sole discretion, without prior notice; your continued use after such changes constitutes binding acceptance.
Borderly is an AI-powered tool that processes user-supplied CV/resume content and produces transformed outputs. The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis. We make no representation or warranty that the Service will be uninterrupted, error-free, accurate, complete, secure, suitable for any purpose, or compliant with any specific jurisdiction's labor, hiring, or anti-discrimination laws. AI outputs are probabilistic; you alone are responsible for reviewing, editing, fact-checking, and verifying every transformed CV before any use.
Borderly does not, and cannot, guarantee that use of the Service will result in employment, interviews, ATS pass-through, salary improvements, visa sponsorship, relocation, or any other outcome. All statistics, testimonials, success rates, ATS scores, and case studies are illustrative, non-binding, and shall not constitute warranties, representations, contractual commitments, or grounds for any claim against us.
All payments are processed by third-party providers (e.g., Lemon Squeezy, PayPal). All sales are FINAL and NON-REFUNDABLE, including but not limited to one-time "Pack" purchases, monthly subscriptions, annual subscriptions, unused credits, partial usage, accidental purchases, duplicate purchases, dissatisfaction with output quality, or inability to use the Service for any reason. By purchasing, you irrevocably waive any right to refund, chargeback, return, or compensation, to the maximum extent permitted by applicable law. Credits are non-transferable, have no cash value, expire when your account is closed or terminated for any reason, and may be revoked at our discretion. Chargebacks initiated through your bank or payment provider will result in immediate, permanent account termination, forfeiture of all remaining credits, and may be reported to collection agencies.
All Pro subscriptions automatically renew at the end of each billing cycle (monthly or annual) at the then-current price, charging your saved payment method without further notice. You authorize us and our payment processors to charge your method on file indefinitely until you cancel from your dashboard. Cancellation takes effect at the end of the current paid period; no pro-rated refunds will be issued. Pricing may change at any time; renewals after a price change constitute acceptance of the new price.
By uploading, pasting, or submitting any content ("User Content") to the Service, you grant Borderly an irrevocable, perpetual, worldwide, royalty-free, fully-paid, transferable, sublicensable license to host, store, reproduce, modify, create derivative works of, publish, distribute, anonymize, aggregate, and use User Content for the purposes of operating, improving, training, evaluating, marketing, and developing the Service, our AI systems (including model fine-tuning on anonymized data), and any successor products. You represent and warrant that you own or have all necessary rights to grant this license and that User Content does not infringe third-party rights.
All software, code, design, prompts, AI orchestration, templates, scoring methodology, brand assets, copy, and the Borderly name, logo, and trade dress are the exclusive property of Borderly and/or its licensors and are protected by intellectual property laws. Transformed CV output may be used by you solely for your personal job-search purposes. You may not (a) resell, sublicense, or commercialize Service output; (b) use the Service to train competing AI models; (c) reverse-engineer, decompile, scrape, or attempt to extract our prompts or models; (d) use the Service to generate fraudulent, misleading, or deceptive resumes. We may terminate accounts violating this clause without refund.
You agree not to: misrepresent your identity; upload content you do not own; use the Service for illegal, harassing, discriminatory, defamatory, or fraudulent purposes; circumvent payment, rate-limit, or credit systems; share accounts; use bots or automated tooling; or interfere with the Service. We reserve the absolute, unilateral right to suspend, restrict, throttle, or permanently terminate any account, at any time, for any reason or no reason, without notice and without refund. We are not obligated to provide an explanation, appeal process, or data export upon termination.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR FREEDOM FROM HARMFUL COMPONENTS. WE DO NOT WARRANT THAT TRANSFORMED OUTPUT IS FREE OF ERRORS, HALLUCINATIONS, BIAS, OR FABRICATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BORDERLY, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, REPUTATION, EMPLOYMENT OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNT YOU ACTUALLY PAID TO BORDERLY IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $20.00.
You agree to defend, indemnify, and hold harmless Borderly, its owners, employees, contractors, agents, and affiliates from and against any and all claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service; (b) your User Content; (c) any violation of these Terms; (d) any false, misleading, or fraudulent statements in resumes generated through the Service; (e) your violation of any third-party right; or (f) any claim by an employer, recruiter, or government agency arising from your CV.
We process the data you provide to operate the Service. We may store, anonymize, aggregate, and use such data for analytics, model improvement, and business operations. By using the Service you consent to such processing. You are responsible for not uploading sensitive personal data of third parties, classified information, or material that violates privacy laws. We disclaim liability for any third-party data you choose to upload.
We may, at our sole discretion and at any time, modify, suspend, discontinue, redesign, reprice, limit, or remove any feature or the entire Service, with or without notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service, nor are we required to issue refunds or credits as a result.
The Service integrates third-party providers (e.g., Anthropic, Clerk, Supabase, Lemon Squeezy, PayPal, Vercel). We are not responsible for the acts, omissions, availability, pricing, terms, privacy practices, or outages of any third party. Your use of those services is governed by their own terms.
These Terms are governed by the laws of the Republic of Peru, without regard to conflict-of-law principles. Any dispute, controversy, or claim arising out of or related to the Service or these Terms shall be resolved exclusively through binding individual arbitration seated in Lima, Peru, conducted in Spanish or English at our election. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION AGAINST BORDERLY. To the extent any dispute is not subject to arbitration, the courts of Lima, Peru shall have exclusive jurisdiction and you irrevocably submit to such jurisdiction.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force, and the invalid provision shall be reformed to reflect the original intent to the maximum extent permitted. These Terms, together with any policies referenced herein, constitute the entire agreement between you and Borderly and supersede all prior agreements, communications, or understandings.
